Restraining Orders

California Restraining Orders

Emergency Protection Order: An emergency protection order can be issued by police at the scene of a domestic disturbance. An EPO will prohibit a defendant from going near an alleged victim. These orders typically last for up to a week and can result in the temporary loss of your residence and the loss of the ability to visit your children.

Temporary Restraining Order: A spouse may seek a TRO in family court, which is effective for several weeks until a full hearing can be held. Like an EPO, a TRO can prevent you from returning home, visiting children or even retrieving belongings from your residence.

Permanent Restraining Order: The most serious type of restraining order, a PRO is issued after a court finding and can last 5 years or longer. A permanent restraining order requires a defendant to stay at least 100 yards away from the victim and permits no contact, including telephone calls, letters, e-mails or other forms of communications.

Domestic violence charges and restraining orders can have a dramatic impact on divorce proceedings. Such orders can protect a spouse and family from harm; prohibit the offender from returning home, visiting children or taking possessions; and can provide a parent with temporary custody of children and temporary possession of the home, both of which can have a positive impact on the outcome of a divorce case.

Conversely, domestic violence charges, restraining orders and child abuse allegations are often abused or used vindictively by a spouse seeking the upper hand in a contentious divorce case.
