Divorce Questions Answered

A marriage is a relationship between a man and woman that is expected last till the end of their lives. However in many cases today, marriages reach a point where the couple don’t want or feel like living together. In such cases, the couple seeks a divorce which is a separation through court that considers their marriage void and that the two henceforth live as two separate individuals.
There are different types of divorce laws implemented to a divorce, depending on the state you live in and how you want your divorce to work out. Different states have different views on divorce law other than the national government. In the case of an absolute divorce, there is a termination of the marriage because of some misconduct in the marriage or some other statutory cause. With the completion of this form of divorce, the couple stays single.
In the case of a limited divorce, the divorce leads to a separation decree where the divorce law considers you as a couple, though you both don’t live together. Some states offer another divorce law where you have the option of a no fault divorce.

No Fault Divorce

With a no fault divorce, the couple does not actually have a reason or cause for the failure of the marriage. According to divorce laws, the judge or court of law originally needed some proof for the divorce. There was a requirement of proof that a party in the divorce had done something wrong like adultery or some other act for the divorce to be considered possible.
With the no fault divorce, it lets the divorcing couple save their face by not having to wash their dirty linen in front of others to get their divorce through. So if the couple does not have much proof or does not want to discuss their problems in public, some states provide them with a divorce wherein the couple is then considered single.

Contested and Uncontested Divorce

San Diego Divorce laws also have divorce decrees that can be contested out. Here the couple applying for a divorce has to solve some problems in court like the custody of their children and the rights over their property. San Diego divorce laws regarding children have to decide if it is the father or mother who has restricted rights for seeing their children. Regarding alimony, the divorce court takes time to observe both parents before coming to a decision in a child custody case.

San Diego divorces that involve property have a few points that have to be considered according to the divorce law. If there was a prenuptial agreement signed between the husband and wife before marriage then the divorce follows the terms of the agreement unless there are some other satisfactory grounds. Usually divorce law divides the assets between the two people involved in the marriage.
So San Diego divorce law related topics are diverse with different laws catering to different marriage situations and preferences. It is thus better to find out more about divorce law related topics by discussing matters with a California certified divorce lawyer or by surfing a few divorce related sites on the internet such as the California State Bar or the San Diego Superior Court website. You will then have a better idea of where your case stands.
